Britney freed: Judge dissolves Spears’ conservatorship

Britney Spears is free

A Los Angeles judge on Friday ended the conservatorship that has controlled the pop singer’s life and money for nearly 14 years.

The decision capped a stunning odyssey that saw Spears publicly demand the end of the conservatorship, hire her own attorney, have her father removed from power and finally win the freedom to make her own medical, financial and personal decisions for the first time since 2008.

Britney Spears Conservatorship Dispute

“As of today, the conservatorship of the person and estate of Britney Jean Spears is hereby terminated,” Judge Brenda Penny said.

Jubilation erupted outside the courthouse, with fans cheering and shouting after the decision was announced. The crowd chanted “Britney! Britney! Britney!” and fans sang and danced to Spears’ song “Stronger.”

Spears promptly tweeted about the decision: “Good God I love my fans so much it’s crazy!!! I think I’m gonna cry the rest of the day!!!! Best day ever … praise the Lord … can I get an Amen???”

Spears’ attorney, Mathew Rosengart, told fans and reporters that the case “helped shine a light on conservatorships and guardianships from coast to coast, from California to New York. And that took a tremendous amount of insight, courage and grace.”

The judge’s move was widely expected, with little support left for prolonging the legal arrangement. No new arguments were offered at the 30-minute hearing. Spears did not attend.

As recently as last spring, it appeared that the conservatorship could continue for years. Then it unraveled with surprising speed.

Key to the unraveling was a speech Spears made at a hearing in June when she passionately described the restrictions and scrutiny as “abusive” and said “I just want my life back,” a line her lawyer repeated in court Friday. Spears demanded that the conservatorship end without any prying evaluation of her mental state.

Legal experts at the time said that was unlikely to happen, and would represent a departure from common court practice.

But the judge said at Wednesday’s hearing that California law did not require her to order further evaluation of Spears if no one requested it.

why did britney spears have a conservatorship ?

Britney Spears: Singer’s conservatorship case explained

Many aspects of Britney Spears‘ finances and personal life have been controlled by her father and others for the past 13 years under a form of legal guardianship called a conservatorship.

It was set up in 2008, after the US pop star, known for hits like Oops I Did It Again! and Toxic, faced a public mental health crisis.

Why was the conservatorship set up?

The singer began behaving erratically in 2007 after her divorce from Kevin Federline was finalised and she lost custody of their two children.

A series of public incidents raised concern about her mental welfare, with the star making headlines for shaving her head and hitting a photographer’s car with an umbrella.

In 2008, she was twice admitted to hospital under a temporary psychiatric assessment ruling, including after an incident in which she allegedly refused to surrender her sons in a stand-off involving police.

A temporary conservatorship was established around this time and made permanent later that year.

In recent court filings, her father Jamie’s lawyers had said the conservatorship was “necessary to protect Britney in every sense of the word”. They said: “Her life was in shambles and she was in physical, emotional, mental and financial distress.”

Why was Britney under conservatorship?

Britney was put under conservatorship following her very public breakdown in 2008. Following a year of seemingly erratic behavior—such as shaving her head and attacking a paparazzo’s car with an umbrella—the singer was put under a “5150 hold” in a psychiatric hospital for a mental health evaluation.

What happened with Britney’s conservatorship?

September 7th. Jamie Spears filed a petition to end his tenure as the court-ordered conservator of Britney Spears’ estate. … Spears wants to terminate the conservatorship and believes that she can handle her own life, Mr. Spears believes that she should get that chance.”

Britney Spears Is FREE From Conservatorship

Free Britney movement

The Free Britney (or #FreeBritney) movement is a social movement to grant American singer Britney Spears autonomy from her conservatorship, which began in 2008.

The movement became popular in 2019, after the emergence of allegations involving Spears’s time in a psychiatric facility early in the year. The conservatorship was terminated on November 12, 2021.

Conservatorship definition

Under U.S. law, conservatorship is the appointment of a guardian or a protector by a judge to manage the financial affairs and/or daily life of another person due to old age or physical or mental limitations.

A person under conservatorship is a “conservatee”, a term that can refer to an adult.

A person under guardianship is a “ward”, a term that can also refer to a minor child. Conservatorship may also apply to corporations and organizations.

The conservator may be only of the “estate” (financial affairs), but may be also of the “person”, wherein the conservator takes charge of overseeing the daily activities, such as health care or living arrangements of the conservatee. A conservator of the person is more typically called a legal guardian.

What is #FreeBritney?

#FreeBritney is no longer an activist rallying cry: It’s now a fact.

The conservatorship that had controlled Britney Spears’ finances, personal life and medical decisions since 2008, and which for many years was controlled by her father, Jamie Spears, was terminated Friday afternoon in a Los Angeles courtroom. Judge Brenda Penny said the conservatorship of Spears’ person and her estate is “no longer required, effective immediately.”

For most of the time she was under the conservatorship, the singer has said, she masked her true feelings about the situation, but she began speaking out publicly this summer, asking for the legal arrangement to be terminated.

The conservatorship was split into two parts: the conservatorship of Spears’ estate, which controlled all her income and financial decisions, and the conservatorship of Spears’ person, which was in charge of her well-being and health.

Jamie Spears

Jamie Spears had been suspended as conservator of her estate in late September, after the singer accused her father of exploiting her. Since then, the conservatorship of her estate had been placed with a certified public accountant named John Zabel, who will stay on briefly to transfer her assets into her trust. Since 2019, the conservator of Britney Spears’ person was a licensed personal fiduciary and care professional named Jodi Montgomery.

Speaking outside the courthouse on Friday, Rosengart addressed Britney Spears’ future.

“What’s next for Britney, and this is the first time this could be said for about a decade, is up to one person: Britney,” Rosengart said. “I will say that Britney has been put into a position through our collaboration and the work of our law firm to succeed … As of today, Britney is a free woman, she’s an independent woman.”

Britney Spears tweeted a video from the celebration outside the courthouse, writing, “Good God I love my fans so much it’s crazy.”

John Zabel, who was appointed temporary co-conservator of Britney Spears’ estate in following her father’s suspension, will retain administrative powers to assist in the transfer process. He will be allowed to execute estate planning documents and the transfer of assets. No parties objected to his continued role.

A hearing scheduled for Jan. 18 will finalize the transfer of assets and any other pending financial items.

Britney Spears informally asked the court to terminate her conservatorship during rare testimony June 23, during which she described her situation as abusive and traumatizing. Rosengart filed her official request for termination at the end of October, a month after her father, James “Jamie” Spears, was suspended as conservator.

The New York Times reported in September that Jamie Spears allegedly had recording devices planted in his daughter’s home and monitored privileged communications with her previous attorney. Rosengart has asked for all documents and communications involving electronic monitoring and recording devices in Britney Spears’ home as part of a discovery demand following Jamie Spears’ suspension.

Representatives for Jamie Spears have repeatedly denied abuse allegations and said that he has only acted in his daughter’s best interest. Jamie Spears’ former attorney, Vivian Thoreen, said in September that her client “does not answer to the court of public opinion; he answers to a court of law, the probate court.”

What’s going on with Britney and her dad?

Jamie Spears was in charge of both parts but stepped down as his daughter’s personal conservator in 2019 citing health reasons, replaced by a court-appointed care professional. Mr Spears was suspended as conservator of her financial estate in September 2021, replaced by an accountant chosen by Britney and her lawyer.

How much does Britney Spears pay her father?

According to Forbes, Jamie has made at least $5 million from Britney’s conservatorship. Per court documents reviewed by Forbes, Britney has had to pay her father $16,000 per month since February 2009 as her conservator. In 12 years, that amount has equaled to $2.4 million.

Britney Spears’ fiancé Sam Asghari is celebrating her newfound freedom.

Shortly after Los Angeles County judge Brenda Penny terminated the star’s 13-year conservatorship on Friday, the actor-fitness enthusiast posted an image of the words “Freedom” to his Instagram.

On Twitter, Britney shared a video of fans cheering outside the courthouse and wrote, “Good God I love my fans so much it’s crazy !!! I think I’m gonna cry the rest of the day !!!! Best day ever … praise the Lord … can I get an Amen ???? #FreedBritney.”

The night before the hearing, Asghari, 27, posted a video to his Instagram of him and Britney, 39, both wearing shirts that read “#FreeBritney,” and below it: “It’s a human rights movement.”

“Loading….” Asghari captioned the post.

In his Instagram Story that night, Asghari also shared a picture of their Doberman puppy Porsha wearing a matching “#FreeBritney” shirt.
